It's over, Mr. Stevens

The Federal Court of Canada has turned down disgraced Mulroney cabinet minister Sinclair Stevens's application to have the federal PC party resurrected:

Former Progressive Conservative party cabinet minister Sinclair Stevens has lost a court bid to resurrect the old Tory party.

The PC party disappeared last December, when it merged with the Canadian Alliance, to the disapproval of some of the party's old guard, including former prime minister Joe Clark.

Justice Elizabeth Heneghan of the Federal Court dismissed Stevens' application to resurrect the PC party and put it back on the register of official parties.

"The applicant and other members of the PC party had the opportunity to vote upon the resolution that was submitted. The vote was taken and a majority voted in favour of the resolution. The democratic process was respected, " Heneghan said.

Stevens wanted the Tories put back on the register of official parties, arguing in court that Canada's chief electoral officer, Jean-Pierre Kingsley, had been hasty in approving the merger.

In Stevens' view the merger violated the old PC party's constitution. He also said the new party should have no right to PC party funds.

Heneghan found no errors on Kingsley's part in accepting the merger. And though she said Kingsley should have waited 30 days before registering the new party, she added that error had no material effect, and she rejected the Stevens application.
