Surely you can still link internationally to another blog without actually quoting the post? If the NYT carries the news will Canadians be prohibited from reading that edition?
Sounds more like apartheid era South Africa.

A jury is not perfect and neither are the "Men in Black Robes". Says something about a jury that will not judge the facts presented in court but go by the gossip in the street.

It's not as if (Blog of the Year) Captain's Quarters Blog was some covert Canadian Gov't archive requiring a secret password on a secure screen. Even Rubert shows up! Cap'n Ed is part of the New Media. He probably has more readers on a daily basis than any single NY Times writer. If not, that's still the scale of his reach.

Instapundit too... another site that probably gets more readers a day than any two newspapers and television stations in Canada combined. Another global reputation on the daily watch list of Canadians.

Winds of Change.net Yep, obscure *secret* (shhhh) website running on Hosting Matters (ahem) puny servers. Nope, nobody around the world EVER surfs that site, especially Canadians. [/sarcasm]

The point being, that the Courts' going after Canadian bloggers who merely report that Americans are reporting (a) will be like chasing echoes of a scream and (b) will not serve Justice nor serve the image of the Court and (c) only exacerbate the "problem" of Canadians' attention to the facts.

It would be far more productive to focus energy, attention and precious taxpayer dollars on the real problems of corruption, oui?

As much as Kinsella is backtracking on this Gomery thing and attacking conservative bloggers for it, I think he is reverting back to his prior principles of limited speech.

From what I know of Kinsella, he seems to be in favour of hate crime laws that limit free speech that are based on hate. Thus, he is not the free speech advocate some people may think he is.

I do fault him for the impact that blogs have on information though. He does not really grasp the medium I think. Whether it is information available on US servers or other blogs who attack him (where he has threatened to sue them unless they take down the posts), he does not grasp that blogs are a bit of a free for all that stimulate debate and keep others accountable.

I do not think Kinsella believes in the beloved Charter as much as he believes in big and strong government, which limits speech.
